How Is Spousal Support Calculated?

Spousal support is not awarded automatically. In reaching an agreement regarding support, the following factors are considered:

  • The income and financial resources of each spouse
  • The standard of living that was acquired during the marriage
  • The age of each spouse
  • The employability of nonworking spouse

Support is determined primarily by the disparity in gross annual income with other factors taken into consideration. Certain circumstances such as adultery grounds would likely prohibit an award of spousal support to the guilty party.

How Long Will Support Last?

The duration of support will depend upon many factors. Rehabilitative support is for temporary situations, such as when a spouse needs time to become self-supporting. Periodic support is for longer durations of time (often not ending until death) and usually awarded when the length of the marriage has been a substantial amount of time. A lump-sum payment may also be appropriate and paid one time.
